These Terms of Service ("Terms") govern your use of our website (https://www.djomstowing.com) and all towing, recovery, and roadside assistance services provided by Djom's Towing and Recovery ("we," "us," or "our") across Lincoln, Nebraska, and surrounding regions. By requesting service by phone, through our website, or in person, you agree to be bound by these Terms.

1. Authorization & Legal Ownership

By requesting towing or roadside assistance from Djom's Towing and Recovery, you represent and warrant that:

• You are the registered owner of the vehicle, or have explicit legal authority from the owner or an authorized law enforcement/property representative to authorize towing and transport.
• You will provide valid government-issued photo identification and proof of vehicle ownership/authorization upon request by our driver.
• You authorize our operators to perform necessary procedures (including winching, hookup, lockout opening, or loading onto flatbed trucks) to accomplish the requested service.

2. Scope of Services

We provide professional 24/7 automotive services including:

• Emergency Towing: Light, medium, and heavy-duty towing for passenger cars, SUVs, and commercial trucks.
• Flatbed Transportation: Damage-free hauling for all-wheel drive, classic, luxury, and low-clearance vehicles.
• Roadside Assistance: Battery jump-starts, flat tire changes using the vehicle's functional spare, lockout vehicle access, and emergency fuel delivery.
• Vehicle Recovery & Winching: Off-road extraction, ditch pull-outs, and accident scene recovery.
• Long-Distance Towing: Interstate and statewide planned vehicle transport.

3. Pricing, Quotes & Payment Terms

Our pricing is transparent and competitive:

• Estimates: Verbal or online quotes provided are based on the initial information you supply (vehicle make/model, condition, exact location, and destination). Final charges may vary if actual conditions differ (e.g., missing keys, locked wheels, inaccessible terrain, extra winching required).
• Payment Due: Payment in full is due immediately upon completion of services, prior to the vehicle being unhooked or released at the destination, unless direct billing to an authorized insurance or commercial account has been approved in writing in advance.
• Accepted Forms of Payment: We accept all major credit and debit cards (Visa, MasterCard, American Express, Discover), mobile payments (Apple Pay, Google Pay), and cash.
• Storage & Impound Fees: If a vehicle must be stored at our secured facility due to lack of drop-off access, insurance hold, or customer request, daily storage fees established under Nebraska state guidelines will apply.

4. Dispatch Times & Cancellation Policy

Our dispatchers work promptly to assign the nearest operator. Response times (such as "Under 30 Minutes") are estimates influenced by traffic, severe weather, road closures, and call volume. We cannot guarantee exact arrival times.

5. Pre-Existing Conditions & Inspection

Prior to hooking up or loading your vehicle, our driver will perform a preliminary visual inspection:

• Djom's Towing is not responsible for pre-existing damage, including but not limited to prior collision damage, mechanical failure, structural frame rust, flat tire wear, or cracked windshields.
• Customers are strongly advised to remove all personal valuables, electronic devices, money, and personal property from the vehicle before transport. Djom's Towing accepts no liability for personal items left unattended inside the vehicle.

6. Safety & Right to Refuse Service

The safety of our drivers, customers, and the motoring public is our highest priority. Djom's Towing and Recovery reserves the right to decline or suspend service if:

• Weather, highway, or environmental conditions present an imminent danger to life or equipment.
• The customer is visibly intoxicated, belligerent, abusive, or poses a threat to driver safety.
• The vehicle is suspected of involvement in unlawful activity or lacks appropriate legal documentation.

7. Limitation of Liability

Djom's Towing and Recovery maintains comprehensive commercial general liability and cargo insurance coverage in accordance with State of Nebraska regulations. In no event shall Djom's Towing and Recovery be liable for any indirect, incidental, or consequential damages resulting from delays, inability to service, or mechanical breakdown beyond our direct control. Any claims of damage during towing must be reported in writing to our office within 24 hours of delivery.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law principles. Any legal dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Lancaster County, Nebraska.
